PREAMBLE
Previous considerations:
When you make a purchase through this page and when browsing it, you accept these terms and conditions and their validity over any other buyers’ terms and conditions.
As a condition to use this page as a means of purchase, the buyer: (i) confirms that all the information entered on this website or provided by email/telephone/online chat/in person is true, accurate, current and complete, (ii) is fully aware of the technical /aesthetical characteristics of the product that they are purchasing, as well as the installation and cleaning recommendations (iii) has legal authority to formalise this agreement and to use this website in accordance with all the terms and conditions specified here.
The seller reserves the right, at its sole discretion, to deny any purchase, at any time and for any reason, including the breach of this contract.

SALE CONDITIONS

All products are manufactured in Morocco (country of origin).

Tanger Decor Industrie sarl (seller of the goods), is a Moroccan company, with no establishment in the US, Canada, or other region than Morocco. Zellige orders from "US stock" or "USA stock" are orders available to ship within a shorter timescale, they do not qualify as orders from the US territory.

Note: Factory orders are generally imported into the EU (Spain) and temporarily stored in Seville, Spain. Large orders may ship directly from Morocco by the full container / FCL only. Shipping must be organised out of Tangier Med port, Morocco.
Price:
Prices indicated exclude transport, taxes, duties, handling, and any other associated costs where applicable.
A quotation will be prepared to confirm full prices and shipping conditions.
Minimum order quantities:
- US stock: 10 square meters / approx. 100 square feet.
- Factory stock and production orders: 20 square meters / approx. 200 square feet.
- Special conditions may apply on some products.
Payment:
- Prices are quoted in USD.
- Stock orders are payable in full upon ordering.
- A first payment of 50% may be accepted on production orders with the balance due prior to shipping.
- All orders are final – Returns are not accepted.
- Quotations are valid 30 days except on quotations including AIR transport as costs are time sensitive.
Transport and delivery:
- Standard tiles are generally packed in cardboard boxes of between 12 and 30 kg each (25 to 65lb approx.), loaded on a protected and sealed pallet. Larger tiles and slabs are placed directly on a protected pallet.
- For most destinations, Mosaic Factory can offer a shipping option using an international logistics company. Transport is usually organised by land and / or sea freight. Incoterm conditions vary depending on the destination.
- Clients may collect their order (Ex Works conditions / EXW) and organise shipping with the transport company of their choice, at their own cost and responsibility. Shipping / handling / storage costs may apply.
- Shipping & delivery lead times are only estimations. We cannot be held accountable for unforeseen delays (weather, traffic, customs delays, freight circumstances, etc.).
Notes:
- Mosaic Factory’s preferred shipping is by land and / or sea. Air freight may be considered on request.
- Shipping times provided online and by our representatives are estimated. Delivery dates cannot be guaranteed.
- Freight costs are time sensitive and subject to change. Any difference will be communicated and an additional payment will be requested.
- Due to issues than can affect global shipping, freight rates may increase daily, additonal surcharges may be applied or shipping times may take longer than initially estimated due to rerouting or the decrease in vessel availibility. We cannot be held responsible for these events out of our control.
- US STOCK orders or DAP/DDP conditions, the delivery information below applies:
- Delivery address must be accessible to a large delivery vehicle. Curb side delivery & paved road ONLY.
- Unpacking of the pallet/transportation to the building site or upper floors not included.
- Any factors (ferry access/gated community) that may affect delivery to the location should be communicated and may incur additional costs.
- While a delivery day may be communicated, a specific time slot cannot be confirmed.
- Additional delivery fees may be applied for storage or failed deliveries.
Upon reception of the order:
- Any visible damage to the pallet should be documented and communicated to the customer service department within 48h. A brief description of the damage should be indicated upon signing the proof of delivery. Any claim must include photos.
- The order must be checked, and any missing/incorrect items should be communicated to the customer service department within 48 hours of delivery. Replacement tiles/partial refund can be evaluated if any of these conditions are met:
- Incorrect product sent.
- Incorrect quantity received.
- Damaged products.
- We reserve the right to refuse claims made after 48 hours of delivery or when shipping in part or in full is organised by the client.
Returns:
- Returns are NOT accepted.
Storage costs:
- Stock orders, can be stored for up to 2 weeks free of charge after order confirmation. After this time, additional fees may apply.
- For storage of factory orders, after a grace period, a cost of $3 per calendar day per pallet may apply, contact us per email.
Measurements, quantities:
Mosaic factory ® may assist clients with calculations, however, it is the buyer’s sole responsibility to confirm the measurements and total quantities on the order sheet are correct. We cannot be held responsible for any discrepancies. Client should confirm quantities with their contractor. It is recommended to include an extra percentage for cutting, waste, potential light damage and tile selection.
Sales contract:
The quotation received from our customer service department acts as a sales contract and includes: images and details of the tiles ordered, quantities, financial and shipping information. By making payment, the client accepts this sales contract and agrees to these terms and conditions.
Disclaimer:
Mosaic factory ® provides general recommendations for laying and maintenance (verbally, PDF, online, videos) but its liability is strictly limited to supplying the tiles. The company cannot take responsibility for issues linked to installation, cleaning or maintenance. Clients are encouraged to confirm everything with their contractor. No returns or claims will be accepted once the tiles have been installed.
Mosaic factory ® Zellige, Terra tiles / terracotta, Terrazzo, Granito and Cement tiles show variations in tone, texture, size and finish with irregularities due to the manufacturing processes and nature of the products. Each tile / piece is unique. These characteristics are an integral part of the charm of the tiles and will not be considered valid reasons for a return/refund.
It is the sole responsibility of the buyer to ensure they are familiar with the products prior to placing their order.
LEGAL AND PRIVACY
The privacy of your personal data will always be ensured by Mosaic Decor SARL, complying with the applicable legislation on data protection.
Mosaic Decor Sarl reserves the right to make, at any time and without prior notice, changes to the contents and presentation of its websites.
Limitation of liability:
Except in those cases expressly described in the Legal Notice and the rest of the regulatory framework of the website, Mosaic Decor SARL is not responsible for damages of any kind that may arise from the lack of accuracy, errors or omissions of information in this website.
Communication and notifications:
All communications and notifications made will be considered effective for all purposes when they are made through email to the e-mail address provided by the user. The user will keep Mosaic Decor Sarl informed of any changes that may occur in their personal information and e-mail address. The user expressly acknowledges that said data has been provided by himself and is completely true.
Information will be included in a file owned by Mosaic Decor Sarl and used to make communications about the products in which the user has shown interest, news, as well as communication of the purchase process.
The data of customers who make a purchase (except credit/debit card details), will be stored indefinitely for future use should additional tiles be required or new orders placed. Clients have the right to request the deletion of their data by sending an emai to info@mosaicdecor.net where we will proceed to remove all personal data related to the order (preventing access to any information on the product purchased, should additional tiles be needed).
Intellectual and industrial ownership:
Mosaic Decor Sarl is the owner of the Intellectual and Industrial property rights of the content and products shown on this website.
It is strictly prohibited to reproduce, make available to the public and in general any other form of exploitation of all or part of the contents of this website, as well as its design. These acts of exploitation may only be carried out with the written authorisation of Mosaic Decor Sarl.
Personal data protection:
Mosaic Décor SARL will ensure the appropriate security measures are in place to securely store and protect the personal data provided by the user (email and contact information, name and telephone will be stored).
Users and customers may exercise at all times the rights of access, rectification, cancellation and opposition of their personal data, in accordance with the provisions of current regulations through the email info@mosaicdecor.net indicating "Delete personal data REQUEST" in the subject.

This Legal Notice is governed and interpreted in accordance with Moroccan legislation.
The user, expressly waives any other jurisdiction that may correspond and is subject, except in cases where otherwise provided by law, to the jurisdiction and competence of the Courts and Tribunals of Tangier (Morocco) for the resolution of any disagreement that may arise from the interpretation, application and compliance of this Legal Notice, as well as the claims that may arise from any use.
Payment:
The processing of payment information is managed through an external secure payment platform called HIPAY. There are anti-fraud filters and it is a payment gateway that complies with all protection and data security regulations.
